General Terms and Conditions (AGB)

1. Scope of application
These General Terms and Conditions apply to all contracts between Manpower Transporte (hereinafter referred to as “Transporter”) and the client for the transportation of heavy objects, in particular pianos, grand pianos, safes, gun cabinets and heavy furniture.
2. Conclusion of contract
(1) The contract is concluded upon acceptance of the order by the carrier.
(2) The order may be accepted in writing, by e-mail or by executing the order.
(3) Amendments or additions to the contract must be made in writing.
3. Scope of services
(1) The transporter shall undertake the transportation of the agreed items by land using the company's own transport vehicles.
(2) The service shall also include carrying the items through stairwells and other access routes at the pick-up and destination locations, insofar as this is necessary.
(3) Loading and unloading work is included in the scope of services, unless expressly agreed otherwise.
(4) The transporter reserves the right to refuse or adjust the transportation if insufficient information on the transported goods is available.
4. Obligations of the client
(1) The client shall provide the carrier with all information required for the transportation in good time, in particular the weight, dimensions and special characteristics of the items to be transported.
(2) The client shall ensure that the access routes at the pick-up and destination locations are freely accessible and that no obstacles impede the transportation.
(3) The client is obliged to ensure that any permits required for the transport (e.g. special permits for access roads or stopping restrictions) are available.
5. Liability and insurance
(1) The transporter shall be liable for damage to the transported items in accordance with the statutory provisions, unless otherwise stipulated in these GTC.
(2) The transporter is insured by law and also has transport insurance.
(3) The transporter is not liable for damage caused by force majeure, insufficient information provided by the client or unforeseeable events.
6. Prices and terms of payment
(1) The transporter's prices valid at the time the order is placed shall apply.
(2) Additional services not included in the original contract shall be invoiced separately.
(3) Unless otherwise agreed, payment shall be due without deduction no later than 14 days after performance of the service.
(4) In the event of late payment, the carrier shall be entitled to charge interest on arrears and reminder fees in accordance with the statutory provisions.
7. Cancellation and withdrawal
(1) The client may cancel the contract free of charge up to 48 hours before the agreed transportation date.
(2) In the event of a later cancellation, the carrier reserves the right to charge a cancellation fee of 50% of the agreed price.
8. Declaration of ownership
The client confirms that the items handed over to the carrier belong to him or that he has the necessary authorization to transport these items. The transporter is not obliged to check for possible rights of third parties.
9. Course of the transportation
(1) The transporter shall contact the client in good time in order to coordinate the transportation process.
(2) Should unforeseen difficulties arise during the execution of the transport, the transporter shall inform the client and find solutions if possible.
10. Data protection and confidentiality
(1) The transporter undertakes to treat all personal data of the client in accordance with the applicable data protection regulations. Further information on data protection can be found in the company's privacy policy.
(2) The transporter will not pass on the client's data to third parties unless this is necessary for the fulfillment of the contract or required by law.
11. Force majeure (force majeure)
(1) The transporter shall not be liable for the non-performance or delayed performance of its contractual obligations if these are caused by force majeure events.
(2) Force majeure includes, for example, natural disasters, strikes, wars, riots, official orders or other unforeseeable and unavoidable events.
(3) The transporter shall inform the client immediately of the existence of force majeure and endeavor to find a solution.
12. Scope of application for international transportation
For cross-border transports, the respective international regulations and the applicable law of the country of destination or origin shall apply in addition to these GTC.
13. Complaints and notices of defects
(1) The client must inspect the goods immediately after delivery for any damage or defects and notify the carrier in writing no later than 7 days after receipt.
(2) Thereafter, the service shall be deemed to have been properly rendered.
(3) In the event of justified complaints, the transporter shall rectify the damage in accordance with the contractual provisions or, if necessary, provide a replacement.
14. Final provisions
(1) German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
(2) The place of jurisdiction is the registered office of the carrier, unless otherwise stated in the contract.
(3) Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
15. Final sentence
By accepting these GTC, the client confirms that he has read and understood them. The transporter reserves the right to amend or adapt these GTC at any time without prior notice. The client will be informed of any changes in good time.
